This memo corrects the effective date of Chapter 411 of the Acts of 2000 (the Noncontributory Pop-Up Act) from April 5, 2001 to April 12, 2001. Boards do not need to recalculate any figures already presented to noncontributory retirees using the earlier date, but should use April 12, 2001 for all future calculations under this Act.

PERAC MEMO #19/2001 M E M O R A N D U M TO: All Retirement Boards FROM: Joseph E. Connarton, Executive Director RE: Effective Date of the Noncontributory Pop-Up Act DATE: March 8, 2001 After consulting with the Legislature, we have determined that the effective date of Chapter 411 of the Acts of 2000, the Noncontributory Pop-Up Act, is April 12, 2001. PERAC Memo #12/2001 indicated that the effective date was April 5, 2001. Any calculations prepared under this Act which have been presented to noncontributory retirees need not be recalculated since the difference is de minimis. Any future calculations prepared should use the April 12, 2001 date. We trust the foregoing is of assistance. If you have further questions or concerns, please contact this office.
