Commonwealth of Massachusetts et al. DATE: September 20, 2000 As I wrote to you on September 15, 2000 (PERAC Memo #40/2000), the Commonwealth has settled a federal lawsuit initiated by the US Equal Employment Opportunity Commission over the accidental disability provisions in G.L. c. 32, § 7(1) which were found to violate federal age discrimination law (both maximum age and “3/2” rule). In early October, PERAC will be holding offering workshops in Somerville, Plymouth and Northampton for retirement board administrators to learn about their responsibilities under this settlement. Barbara Phillips, PERAC General Counsel and Sandor Zapolin, Deputy General Counsel will review the step-by-step procedures involved in: • Searching records and locating potentially eligible individuals • Eliminating excluded individuals • Contacting members • Applying for benefits • Benefits for successful applicants • Reporting to the EEOC • Health insurance • Enforcement provisions Please remember that the deadline for submission of the list of “potentially eligible individuals” is November 4, 2000.
