PERAC MEMO #37/1999 M E M O R A N D U M TO: All Retirement Boards FROM: Joseph E. Connarton, Acting Executive Director RE: Correction to PERAC Memo #33/1999 DATE: September 20, 1999 PERAC Memo #33/1999 incorrectly stated that the decision in the case of Cavanaugh v. MTAERB and CRAB was a final decision. That decision has in fact been appealed to the Massachusetts Appeals Court. Retirement boards should not make any refunds pursuant to this decision until it is final. The Commission will notify all retirement boards if and when to implement this decision in the future. I apologize for any confusion that may have resulted from our previous memorandum.
