PERAC Memo #7 - 1997: Requests for Re-examinations

McGlynn, Executive Director RE:Requests for Re-examinations DATE:January 17, 1997 The recent amendments to G.L. c. 32, §8 now provide that determinations with regard to whether disability retirees are to be re-examined are to be made by the Public Employee Retirement Administration Commission (PERAC) after consultation with the appropriate retirement board. At the Commission’s November 14, 1997 meeting, it was decided that the criteria will be established to implement the re-evaluation and re-examination process outlined in G.L. c. 32, §8. This process is ongoing. The statute also allows a disability retiree to request re-examination. Until PERAC has completed its implementation guidelines, requests for re-examinations from disability retirees are to be processed by the retirement boards in the same manner as prior to the amendments to G.L. c. 32, §8. When a retiree requests a re-examination, he or she should present sufficient medical information to document a change in his or her condition. The Board should review all relevant information and determine whether an examination by a single physician or a three member panel is appropriate. A Request for Medical Re-Examination Form (10-18-792) is to be completed by the Board and submitted to the Commission. All physicians who have treated the retired member or who have examined him or her in connection with any disability insurance or workers’ compensation claim or claim for benefits under G.L. c. 41, §111F must be listed on the form.
